    the owners are willing to negoiate while the players are not

    there both assholes but at least asshole #1 is willing to sit down and try to work it out

    It's a power issue. The owners seized control by initiating the lockout to begin with; DeMaurice Smith then made it clear through his actions that the players were going to be difficult to appease prior to the hearing because they knew it would likely turn in their favor. They'll be very eager to head to the table now while the owners will opt to wait until the appeal to turn things back in their favor.

    As far as a judge "writing the new CBA", that's impossible and leads me to question whether you understand the concept of collective bargaining. The judge can't impose ANY labor restrictions. In fact, the judge can only force them to return to a pre-existing labor construct while they continue to hammer things out. As it stands, the owners are taking that to be 2010's construct. Why is that? Well, the RFA rules piss off the players. Why care about that? Once again, power.

    Yes, but there's some dispute as to what rules they'll actually return to. We'll likely hear that tomorrow or Friday as Roger is forced to re-open the league...unless he tries to slam through a stay via the CoA. If we go back to 2010 rules, let's hope the team immediately turns to Braylon's agents and tries to strike a new contract.

    What a mess, but hopefully this gets the ball rolling on the season. Minicamps should be running in a few weeks I would think.

    RE: ORDER DENYING STAY

    Last night, Judge Nelson issued a 20 page decision denying the NFL’s request to stay (delay) the injunction she issued on Monday in the Brady v. NFL litigation that the NFL must stop the lockout. The decision denying the stay is once again very strong, and rejected all of the NFL’s arguments. Accordingly, the order ending the lockout is in full, immediate force.

    The NFL has filed for an emergency stay with the Eighth Circuit Court of Appeals, while the Eighth Circuit considers the NFL’s stay request. Unless and until such a request is granted, however, we believe the 2011 League Year now has to begin; the Clubs must open their facilities to allow players to work out, meet with coaches and otherwise perform their jobs; and the NFL and the Clubs cannot collectively continue to refuse to deal with players. It is our view that the NFL and the Clubs will be in contempt of court if they do not comply with the order unless and until they hear differently from the Eighth Circuit. We will let you know later today what the NFL is going to do to comply with this order, and what the specific schedule will be going forward."

    Saw that one coming last night. Could be a short 'league year' if the CoA grants a stay quickly. Let's see if anyone oversteps league orders and starts making moves before the CoA rules on the stay.

    I wonder if we could see some signings that end up getting invalidated later on. Probably won't see a damn thing anytime soon. Best case, some players working out.

    So pretty much the NFL owners are telling Judge Nelson to go fuck herself with her ruling.


    If I were her, I would come down real hard on the Owners and hold them in contempt if they dont comply with her ruling. She looks very bad as of right now.

    I am just hopeful I guess, we are getting close to the point of affecting the regular season. Minicamps are normally in May I thought.

    How? By not signing anyone? She can't order them to sign FAs, nor has she tried. She doesn't look bad here, the owners and players still do. Nobody's pinning this on the judge. It was all but obvious that the owners would rush to the CoA for a stay, which is over her head.

    If anyone signs today, it'll be valid. It would just be stupid to actually do so. If you violate the NFL's orders, nobody's going to deal with you. Look at how badly they reacted to the Giants opening up their facilities to 3 players. Now imagine what the NFL and other teams will do to anyone who starts signing players today.

    If I were a GM I'd be pushing for the season to be active today. They could all get so much more accomplished on this Draft day.
