If the restaurant wanted to fight this, I'm fairly certain they'd win.

Sounds like they don't want to make an issue of it and they'll just acquiesce to the annoying woman, but the Jets are in the wrong here.

They can't stop anyone from using the word "Jets". If the restaurant called the dishes "New York Jets" or featured the logo on the menu, around the establishment, or on the food itself, then that would be different.

The jets should cooperate with and support this guy, not impede on the extra 75 dollars he makes a year from adding Jets to the name.

It's pretty obvious that they are trying to play off of the Jets' name and colors. Whether or not the chef did it because he loves the team or solely as a marketing ploy, it's still infringement. They're using the team name and the team colors at a peak of the team's popularity and success to promote their products. They're trying to make a buck off of the brand which is not authorized by the brand's owner. It's infringement.

Is it possible that this woman is choosing to be a c-word and did this w/o asking her bosses if it was cool?

Why? Really, why should the Jets let someone else slap their name all over his menu as a means advertising and marketing without their consent. I rarely root for the multi-million dollar corporation but this is clearly a case of appropriating assets for profit without the owners' consent.

Yea, it sucks that a Jets fan is getting hosed by his favorite team for this. However, a head chef should know what constitutes copyright infringement in advertising. This is basic restaurant/hotel management, something that all top chef schools teach.

Do you really think it's possible that a spokesperson is allowed to say what they want without the boss' permission? Seems kind of antithetical to their job title.

Very petty of the team. Its not a legal infringement because they are not using logos or claming NY Jets dishes. If you sell a green t shirt with the word Jets and a pic of an F14, maybe its cause I like green f14 jets. He's not using a logo or any particular copyright of the NYJets. The 'gotham city football club" doesn't have a leg to stand on. They are being petty. Besides, they better start fishing razzle.com for all the tshirts and shit being sold. They will have a serious bone to pick with StinkyB as well...

I understand your point but there should be some leeway. If the guy is a fan and names a few dishes as a testament to the team I don't think it's worth going to court over. If he was selling jets shirts and plates I'd be more critical but it's a salad and some sushi. The legality is an issue yes, but at this point they're just being pedantic.

maybe they think it will interfere with their offerings of sushi to the club suites.

this doesnt surprise me at all from any nfl franchise. many years ago they would have loved the free advertising. NOW they must protect their name...

That should've been a poll option, that's the most surprising part to me.

It is infringement under the law.

If he asks to do this instead of just doing it I'm sure he can work something out with the team. With this in the paper and the growing support and free advertising this restaurant just got, perhaps the Jets will allow him to continue once the right papers are filed.

This is ridiculous he is not using the logo...he is using the word "Jets".

How can the NY Jets make this claim?

All he needs to do is say he was talking about Jets like the airplanes and the NY Jets can't do anything since their symbol is not directly related. The word Jets is in the English dictionary because it is a noun, a thing. The Jets would have to have clear proof that he was talking about the NY Jets and as far as I am concerned I didn't see NY anywhere in front of the word Jets, so the restaurant should be fine. Either way this is absolutely ridiculous.
