He has already accepted. That article goes on to say he won't use the suit to get out of testifying..he won't seek immunity..etc. You just don't do that if you are guilty and face going to prison for lying in front of a congressional committee. Everybody in Balco had immunity. He doesn't even want it. That should tell a lot. Now McNamee will have to prove it. The thing that has always bothered me about this is that Mitchell went on and on about Clemens in is report but had absolutely no proof whatsoever. He did with everybody else. I suppose MvNamee could have thought he was injecting Clemens with HGH and steroids when it was B12 and lynocaine. I think he said it was provided by Clemens and not himself. Like Clemens said last night, if he was supposed to have bought this stuff where is the guy that said he did? Nobody has come forward saying they sold him anything.
Not quite, now Clemens has to prove that McNamee is lying, he has the burden of proof for bringing up the lawsuit.
You're still on the innocence train, Don? Has to be someone, I suppose. Clemens' attorneys have been so outclassed by McNamee's thus far, I'm less than surprised at this. He has now opened himself up to a McNamee countersuite - which he can't not file; and, he's opened himself up to a full ranged of discovery that he can no longer control. Reckless. Idiotic. The beginning of the end for Roger, unless he can find some quiet way to comfortably withdraw.
Query: Why on earth would McNamee be shooting Roger with lidocaine in his ass? Strange place on the body to want to numb-up. Unless, of course. . . . .
As soon as he said "if he shot me with the stuff he said he did I would have a 3rd ear growing out of my forehead" I knew his story was dead in the water.
I watched. Did you notice his body language and how his eyes darted, like he was "thinking" carefully before his answered. Another thing that bugged me was how he answered questions with a question. Must be taking OJ lessons. If I did it...If he did it...where's the guy...blah blah blah.
Countersuit. Payoff. Both sides confidentiality agreement, McNamee then has a reason to stop talking about Clemens....
At least that's an exit strategy. Might just be that, by the time Henry Waxman has had all the face-time on television he so craves, there might not be much left to keep confidential.
