I'm not sure. I don't know the specifics. Like it was said above the cop may have had to identify himself. If your buddy was getting into a fight and an off-duty cop intervenes and tries to make an arrest and you assault him for messing with your buddy you could be looking at the charge.

It all just depends but here is some information. Even though not on duty they are still an officer of the law. Laws vary per state as well.
