Whatever the legal specifics in terms of ownership and copyright, this is just stupid. Good on the Resteraunt owner for getting into the spirit of things. This is free advertising for the Jets in a way anyways. The Jets aren't losing any money by letting this go - Give me a break, let the guy run his f'ing resteraunt.
what does football have to do with Jets? same difference. I don't know how many times it needs to be stated, but the Jets don't have a TM for the word Jets. it isn't allowed, it is a common word. they have a TM for New York Jets, probably NYJ, the imagery of their logos, and by association their trade dress. I can go out today and sell a hat that says Jets on it and they couldn't do anything about it, and they certainly have no say in whether someone names a dish Jets. clearly their intent is to appeal to Jets fans, but that isn't the same as causing confusion and damage to their TM.
They're PROMOTING the team.....does this Forum pay the Jets to use the phrase "GangGreen" ??? If the Giants had hundreds of restaurants promoting Big Blue food-names, Woody would HIRE someone to promote the Jets in restaurants. The team is getting free publicity.....idiots.
Ummm...if I were Woody, I'd PRAY for that to happen. He's getting free publicity to help sell those PSL's. The Jets have NO LEGAL STANDING.....it's like a bar promoting a Jets game and come on in and get drinks half-price. Do the Jets get a cut of that ?
Sounds like the woman got some bad service and wanted to get back at them. Either way, I don't think they would have a case, the Jets don't own the color green and the word "Jets"
So the argument is that the jets don't have a vested interest in the food and beverage industry; therefore they have no right to protect their name in that industry. Does the jets uncorked wine change this at all?
