He has to prove that he didn't have sex with her. There is no other way out for him, no way around it, and the onus is on him to do so. It's immaterial if she 'lied' about her age, it's immaterial if he 'didn't know how old she was', it's immaterial if she 'consented' to a sexual act. It can't be used as a defense in a statutory rape case in NYS. 16 = below the age of consent. It doesn't look good for him.
