Our culture is just totally screwed. Schefter thought this was something that was ok to post without the patients consent? Somebody thought this was ok to release to a reporter looking to sell?
Any lawyers out there? He has to be able to sue the hospital for this, right? And I lost a lot of respect for Schefter here (or perhaps I shouldn't have had any in the first place?). It's one thing to say 'sources confirm blablabla', but posting his meical chart on Twitter!??? I'd expect that kind of shit from TMZ.
Really interesting developments this am: -JPP also broke his thumb and had a pin and screw inserted, 6 week recovery (2nd or 3rd preseason game at a minimum) -the reason JPP had the finger amputated was because it could have been rebuilt but the recovery would have been much more extensive and lengthy--having the finger amputated will allow him to play much sooner--I'm guessing it was a voluntary choice and not one of necessity -legal analyst from Sports Illustrated said HIPPA does not apply to Schefter and ESPN, as an investigative reported he was doing his job and can't be held liable FOR THE JPP tweet (more on that later) because the story was "newsworthy" -Schefter could have just tweeted that JPP was having his finger amputated--a debate as to whether he needed to post the picture--some are lauding it, some are repulsed by it--but that's become the nature of reporting--someone was going to put it out there so Schefter did it first -total and hefty liability on the hospital for permitting the picture to get in the hands of Schefter--but he does not have to disclose who he got it from, even if subpoenaed and refuses based upon his media privilege--and he's not going to jail even if he refuses because it doesn't involve and national issues -HIPPA violations are typically covered by insurance, but the liability could be quite large and the DOJ and State prosecutors could come down hard on the hospital -by posting that picture--Schefter fucked up because there is also personal identifiers on the photo of a 67 year woman that was having surgery in the same room right before or right after JPP and that is NOT protected because HER story is not newsworthy and he privacy rights were violated--liability for ESPN and Schefter possible as well as the hospital _
Good news! There is a silver lining in all of this after all I guess JPP figured that finger was worth going after a contract sooner rather than later. If that part is true
I think, while somewhat morally reprehensible, it's perfectly within Schefter's rights to post the picture (with respect to JPP) without liabilty because he's just doing his job. He could have done the job just as well by posting a tweet summarizing what was on the medical chart. But we shouldn't blame the messenger too harshly because that's what today's public wants--they WANT the gory details. The HOSPITAL is the real culprit here. Whoever gave him that medical report is the real villain. Having said that, Schefter should have done a better cropping the picture because by posting the personal info about the 67 year old woman, he fucked up. _
Btw, another interesting tidbit. If he signs the tender it means nothing until after his physical because this is a non-football related injury. The Giants would owe him nothing if he fails their physical. But then he'd become an UFA. _

Hope someone tells JPP about the story about Django Reinhardt. Guy lost two fingers and was still able to become the greatest jazz guitarist in history. If anything this accident will just make JPP meaner.
