If by any chance Brady beats this it will be the end of the NFL as we know it. The union will gain the upper hand. I don't think the team owners are taking kindly to this. Apparently there is a relationship between Brady and the union. He agreed to be the plaintiff in a case of theirs a few years ago. So basically they feel they owe him one even though they'd probably do the same for any other player in this situation.
It's not a slam dunk no matter what anyone says that Brady and the union will be victorious this time. They have smart lawyers too and this is a civil type decision they came up with in terms of punishment. When there doesn't have to be an extreme burden of proof. So if it doesn't go to binding arbitration and if the NFL wins in the appeal process. Then it will go to court. Maybe about time the NFL fought back even if it means going to the Supreme Court. To see if they can even regulate their own league esp when the other owners plus the union signed off allowing the Commissioner's office the power to make these kinds of decisions. Then when they are made he gets sued.
Yeah, there is definitely a players union angle here. Kessler has done a lot of work for the union, including on the CBA negotiations. Of course the union doesn't have an interest in letting one of their members in effect cheat against other of their members. But for them the larger issue is weakening Goodell and league management.
Anybody see this recent defense by the Pats that McNally referred to himself as "the deflator" because he was losing weight? It really feels like satire at the most ironic level.
Ftr I think the end game of bringing in the lawyers will be to try and litigate, in court, against the NFL. Personally I think it unlikely that a court would get into relitigating the conclusions of Vincent's decision how to react to the Wells report. More likely is that a court would say the CBA allows the NFL to have hired Wells to do the report after investigating and to make of that report what it wanted (within reason, of course) in handling it, as Vincent did. The net result of Vincent's ruling does not seem to be arbitrary if one accepts the Wells report. More problematic is whether Brady's lawyers can attack the process used, under the CBA - did the process accord with the CBA and general applicable law? That is a more open ended analysis, and while I think the NFL wins there, too, it is potentially problematic. Remember that the NFL entered this period with a major PR problem in terms of their not doing enough to punish players, and how they went about their investigatoins. But that was in the court of public opinion. If a court starts telling them what they can and cant do with these sorts of investigations, it could become a big problem for them.
These incredible excuses that are coming out now are so ridiculous it beggars belief. How could anyone believe that this sort of transparently manufactured nonsense is actually a sensible and measured response to the suspension and other punishments? Brady, Kraft and the entire Patriots organisation is teetering on the brink of complete meltdown. It is so bad I could actually see the league upping the punishment. If there is any reduction with this sort of nonsense being spewed out, then the league loses an awful lot of credibility.
That's what I don't understand. I get that the union is supposed to stick up for the players but when the issue is one player gaining and advantage over the rest, doesn't that hurt the bottom line?
