I would say that the case you describe in the first three paragraphs is the middle ground that neither side can deny, unfortunately. There is no way for a Patriot fan to prove that BB/TB aren't lying and there is no way for a Patriot "hater" can say that Kraft is definitely being dishonest. This is the outline of the gray area, with the truth somewhere in the middle. Everyone may think they cheated, but I don't think anyone outside of a handful of people truly know if they cheated.

The risk/reward of him coming out and making that statement doesn't add up in my head. I happen to believe that Kraft is a good man, but additionally it wouldn't make sense for him to say anything if he knew something was up. There isn't enough benefit to him or the Patriots.
So, if the Pats are found guilty of wrong doing, does Kraft order Billy and Tommy's balls on a plate?

You like Kraft only because he runs a great organization because of Belichick. And you have 3 rings. We have no loyalty to Woody Johnson because he runs a bad org and he has 0 rings. If the Jets were found cheating (and wouldn't that be pathetic, a 4-12 team cheating) they would have no support.
